New Class Action Lawsuit Against Festiva Timeshare LLC

On August 12th in Orlando Florida a Mesothelioma lawsuit was issued by attorney Paul G. Deutsch. This suit has been filed on behalf of a woman who has been diagnosed with cancer due to her exposure to Campgrounds at Festiva timeshares owned and operated by the Festiva Inc. The lawsuit names both the owner of the park and their insurance company, which is called Alar. In this article I will try to give you some information on what the lawsuit is all about and whether or not it may have merit.

Festiva Timeshare Lawsuit

First, as the lawsuit is states a class action lawsuit, meaning that anyone who has been harmed in the event that they were a victim of negligence in this case will be able to join with others in filing suits against Festiva, Inc. and their insurance company, Alar. Mesothelioma is a disease caused by exposure to asbestos. So, according to Mesothelioma Lawyers, this could potentially be the first ever class action lawsuit to ever be filed on behalf of a person that has been harmed due to exposure to the park. Also, this could very well be one of the biggest cases of its kind in the state of Florida and possibly the U.S. as well.

Second, Alar seems to own this park along with its sister companies, inflow Inc. and Silver Star Resorts Inc.

The complaint states that Alar repeatedly knew that there was asbestos in the air, but did nothing to correct this problem. Also, they know that their customers have gotten sick from the toxins in the air, yet did nothing to correct the situation. From this complaint, one can draw the conclusion that this park owner may be partially to blame for the cancer causing toxins in the air. Additionally, if one would like to join the lawsuit, you must contact your Florida State Bar Association and schedule an appointment with a competent lawyer.

Third, Alar has made no efforts to notify the EPA or Florida Department of Health that they had detected dangerous levels of asbestos in the air of their facility.

In fact, it was only after the Times-News exposed the situation to the public that the EPA contacted Alar and requested information regarding their records. Alar did not turn over these records. This is part of the class-action lawsuit that Lularoe is planning against the owner of Festiva Timeshare.

Fourth, according to the complaint, there was an attempt by the owners of Festiva Timeshare LLC to “disappear” the complaint by filing a sham Certification to Preserve Declared Interest.

This class action lawsuit was filed in the U.S. District Court for the Southern District of Florida and is expected to be filed in 2021. Also, there is a pending federal lawsuit against the same owners of Festiva Timeshare LLC. It is also possible that additional lawsuits will be filed in the future as well.

Lastly, Lularoe contends that there is no evidence or proof that any of the above facts apply to their business.

They maintain that there is no basis for any of the above allegations. The original complaint was filed in the U.S. District Court for the Southern District of Florida and is currently pending. If the complaint is granted and a judgment is issued against Lularoe, it is highly likely that the remaining parties will file their own lawsuits against Lularoe. The class action lawsuit and the background check class action lawsuit are expecting to move forward towards trial after the expiration of the statute of limitations in Florida. The dates are unknown at this time.
